[1] On February 12, 2001 Martin Gentile, counsel for the respondent, filed a bill of costs pursuant to the judgment rendered by the Court on January 21, 2000 dismissing the appeal with costs.

[2] In a request for service accompanying the bill, Mr. Gentile asked that the ­

assessment be made without a personal appearance of parties. By letters dated March 20, 2001 Mr. Blanchet, counsel for the appellant, was asked to file submissions in opposition by April 6, 2001 and Mr. Gentile had until April 20, 2001 to file and serve his reply.


[3] It is now April 27, 2001, the opposing party has submitted no opposing representations, I will therefore proceed to assess this bill of costs.

[4] The claims under items 19, 22 and 25 of Tariff B are awarded. As to the claim under item 26, as this assessment was not opposed it seems more reasonable to award 2 units.

[5] As the claim for disbursements made by Mr. Gentile's affidavit was not opposed, it is also awarded.

[6] The respondent's costs are assessed and allowed in the amount of $1,600.00 as fees and $741.39 for disbursements. A certificate is accordingly issued in the amount of $2,341.39.
