Before stating (p. 6012) that he did not feel that he had to "slavishly follow those cases which have characterized child care expenses as personal in nature", Iacobucci J. referred to R. v. Salituro, [1991] 3 SCR 654 where the Court stated (p. 670) that:

"Judges can and should adapt the common law to reflect the change in social, moral and economic fabric of the country".
