Webb JA stated (at para. 38):

Since a deeming provision “effectively alters reality, its meaning should be limited to what is clearly expressed” (La Survivance v. The Queen, 2006 FCA 129, at paragraph 55).

He went on to find that the legal fiction found by the Tax Court to be created by s. 104(19) did not reflect its precise wording.
