Dear Sirs:

Re: Group Sickness or Accident Insurance Plan

This is in reply to your letter dated June 24, 1988 concerning the above matter.

A "group sickness or accident insurance plan" means a plan under which a number of employees are Insured either under a single contract between the Insurer and an employer contracting with the insurer or under individual contracts but pursuant to a common plan.

With the above in mind, it is our opinion that the plan described in your letter structured as a "grouped" plan with individual policies would qualify as a "group sickness or accident insurance plan" provided the individual contracts were pursuant to a common plan.
