The Honourable Otto Jelinek has asked me to reply to your letters of February 20, and April 2, 1990, concerning you scientific research and experimental development activities. I apologize for the delay in my response.

The Department is unable to offer any relief beyond that made available in the letter of February 16, 1990, from the Honourable Otto Jelinek, Minister of National Revenue. The relief was extended after a thorough review of your circumstances including the matters raised in your most recent letter.

Mr. Len Worsfold is the departmental officer in the Vancouver District Taxation Office assigned to your case. He is available to discuss your file, and may be contacted by telephoning (604) 666-3595. You may wish to advise him of the nature of the 24(1) in payments received and identify the years in which those payments were reported on your income tax returns. I would note that failure to report income from a business on your income tax return over an extended period would be an indication to the Department that there was no reasonable expectation of profit.

The objection and appeal proceeds affords the opportunity for a further impartial review of your business affairs. It will be your responsibility to ensure that your request for that review is made within the statutory time limits and that complete information is submitted at that time to support your position.
