We are writing in response to your letter, dated August 21, 1991, wherein you requested our views on whether the comments in a letter you obtained pursuant to the access to Information Act continue to reflect the position of this department. Please be advised that the comment in the covering letter (to which the requested document was attached), indicating that the interpretation letter may no longer reflect the current policy of the department, is a standard disclaimer, included in all such letters.
The specific letter you refer to (file number 5-903559, dated December 27, 1990) does continue to reflect our general views concerning the subject matter of the letter. As the letter indicates, the position we would take with respect to any actual situation would depend upon the particular circumstances, including the terms of the partnership agreement in question and the relevant partnership law.
