QUESTION 20

CAPITAL COST

Does Revenue Canada agree that the determination of capital cost for purposes of paragraph 13(7)(e) has no bearing on the determination of capital cost for capital gains purposes?

DEPARTMENT'S POSITION

The rules in paragraph 13(7)(e) are only for the purposes of, paragraph 8(1)(j) and (p), section 13, section 20 and any regulation made under paragraph 20(1)(a) of the act.  Thus they have no application or relevance in the determination of an individual's capital cost for capital gains purposes.
