Subject: Clearance Certificates Subsection 159(2)
This is in reply to your memorandum of December 12, 1990 regarding our memorandum of November 30, 1990 to Ron Spencer of the Centre for Career Development in respect of clearance certificates.
We are writing to clarify this Division's position on the matter. The memorandum of October 23, 1990 from Ron Spencer of the Centre for Career Development was forwarded to this Division by the AuditApplications Division asking that we reply to it "as the matter involves an interpretation of law". We therefore provided our interpretation of subsection 159(2) of the Act and informed Mr. Spencer that neither of the two cases 19(1) he referred to would cause us to interpret subsection 159(2) differently.
It was not our intention to change any policy of the Department. Rather, since the matter was referred to us by the Audit Applications Division asking that we reply based on our interpretation of the relevant provision of the Act, we assumed that the policy to which you refer did not exist.
