Re: 24(1) Self-Directed Retirement Savings Plan 24(1)

We are writing in reply to your letter of October 26, 1990, which was forwarded to us by the Registered Plans Division on May 6, 1991.  You ask if the terms of the Trust Agreement for the above-noted specimen plan permit investments in non-arm's length mortgages .

Although a non-arm's length mortgage can be a qualified investment for a RRSP, whether the terms of the Trust Agreement permit such an investment is not a question to which we can respond.  An interpretation of the documents governing your plan should be obtained from your lawyer.  If you decide that an amendment is desirable, it will be necessary to submit if for pre-approval to the Registration Directorate of the Department in accordance with paragraph 18 of Information Circular 72-228 (Registered Retirement Savings Plans).
