I am writing in response to your letter of September 15, 1993, in which you inquired whether the Department has finalized the guidelines to be used in determining whether the income of an Indian is exempt in various situations.
The process of consultation for the development of guidelines referred to in my letter of March 10, 1993 is ongoing but nearing completion. However, the Department has not changed its position, as outlined to you at page 2 of my March 10, 1993 letter, that certain types of income will be exempt. Confirmation of this position, together with the Department's position regarding whether income arising in other circumstances is exempt or taxable, will be published in the near future in guidelines which the Department will make available to you and other interested parties.
I am confident that the participation of the large number of Indian organizations and interested parties in the consultative process will lead to an appropriate application of the Williams decision.
