JUDGMENT

The respondent’s motion to adduce new evidence is allowed. The appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 2103-0197A, 2023 ABCA 381, dated December 21, 2023, was heard on April 23, 2025, and the Court on that day delivered the following judgment orally:

The Chief Justice —We are all of the view to allow the appeal. We order that the term of imprisonment imposed at trial be restored. We order that Paul Sheppard surrender himself to the appropriate authorities within the next 48 hours. Reasons to follow.

JUGEMENT

La requête en production de nouveaux éléments de preuve présentée par l’intimé est accueillie. L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 2103-0197A, 2023 ABCA 381, daté du 21 décembre 2023, a été entendu le 23 avril 2025 et la Cour a prononcé oralement le même jour le jugement suivant :
